An ICHRA is always considered an offer of MEC so any employee who enrolls in an ICHRA, even if it is unaffordable, will lose subsidy eligibility.

If an employee is offered an ICHRA that is affordable, the employee, their spouse and eligible dependents are not eligible for a PTC toward coverage through a public Exchange, even if the employee waives the ICHRA coverage.
